INFORMATION ON THE PROCESSING OF PERSONAL DATA I

Information on personal data processing

Dear Sir or Madam,

In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as "GDPR"), we provide you with information relating to the processing of your personal data that you have provided to us in response to a job advertisement or that you will provide to us in this context at a later date.

1. Personal data controller

  1. The controller of your personal data is Nafisipado s.r.o., with its registered office at Na záhonech 809, Michle, 141 00 Prague 4, Czech Republic, ID No.: 172 22 788, registered in the Commercial Register maintained by the Municipal Court in Prague under file No. C 368459 (hereinafter referred to as the "Controller").

  1. The Controller operates as an employment agency licensed to mediate employment in the form of finding employment for natural persons seeking work and finding employees for employers seeking new workers, pursuant to Section 14(1)(a) of Act No. 435/2004 Coll., on Employment, as amended (hereinafter referred to as the "Employment Act").

  1. The administrator can be contacted in the following ways:

a) by email sent to info@talentem.com,

b) by telephone at +420 736 186 528,

c) by post to the address Nafisipado s.r.o., Na záhonech 809, Michle, 141 00 Prague 4, Czech Republic, or

d) by message sent to the Administrator's data box with the data box identifier x76dpab.

  1. The Controller has not appointed a data protection officer.

2. Purposes of processing and related information (legal basis for processing, recipients of personal data, period of storage of personal data)

  1. The basic purpose of processing your personal data is to mediate employment in the form of searching for employees for an employer who is looking for new workers, has hired the Administrator as an employment agency for the purpose of mediating employment, and whose job offer is the content of the advertisement to which you responded (hereinafter referred to as the "Client"). For this purpose, the Controller will analyze the personal data you have provided, and if you meet the requirements for the advertised job with the Client, it will forward your personal data to the Client, who may thus be the recipient of your personal data. The Client may also be a person from a third country (i.e., a country outside the European Union or the European Economic Area), but it will always be a country that the Commission (EU) has decided provides an adequate level of personal data protection. In accordance with Section 17(2) of the Employment Act, your consent is required for the processing of your personal data for the above-mentioned purpose, and the legal basis for the processing of your personal data is therefore the consent of the data subject pursuant to Article 6(1)(a) of the GDPR. You have given this consent by filling in the relevant data in the online form and sending it to the Controller. You were not obliged to provide your personal data to the Controller, but without providing it, the Controller would not be able to arrange employment for you with the Client. The Controller will store your personal data for the above-mentioned purpose only until it decides, based on its analysis, whether to transfer it to the Client or not, unless you withdraw your consent to its processing earlier (see below).

  1. Another purpose of processing your personal data may be to arrange employment for you with an employer other than the Client. For this purpose, the Controller would include the personal data you provide in its records, analyze it in relation to the demand of employers who are looking for new employees through the Controller, and, if appropriate, contact you with a job offer from another of its clients. If you are interested, the Controller would then pass on your personal data to this other client, who would thus become the recipient of your personal data. This other client may also be a person from a third country (i.e., a country outside the European Union or the European Economic Area), but it will always be a country that the Commission (EU) has decided provides an adequate level of personal data protection. In accordance with Section 17(2) of the Employment Act, your consent is required for the processing of your personal data for the above-mentioned purpose, and the legal basis for the processing of your personal data is therefore the consent of the data subject pursuant to Article 6(1)(a) of the GDPR. You could give this consent by ticking the appropriate box in the online form through which you provided your personal data to the Controller. The Controller will store your personal data for the above-mentioned purpose until you withdraw your consent to its processing (see below).

  1. Your rights

  1. You have the right to request access to your personal data from the Controller, i.e., the right to obtain confirmation from the Controller as to whether or not your personal data is being processed, and if so, you have the right to access your personal data and other specified information. You also have the right to have inaccurate personal data corrected or incomplete personal data completed.

  1. If one of the reasons specified in Article 17(1) of the GDPR applies and none of the conditions specified in Article 17(3) of the GDPR are met, you have the right to have your personal data erased.

  1. If the case specified in Article 18(1) of the GDPR applies, you have the right to restrict the processing of your personal data.

  1. Last but not least, you also have the right to withdraw your consent to the processing of personal data for one or both of the purposes of processing specified in points 2.1 and 2.2 of this document at any time. However, the withdrawal of this consent shall not affect the lawfulness of the processing of your personal data based on this consent prior to its withdrawal.

  1. You can exercise all the rights listed here by contacting the Controller at the addresses listed in point 1.3 of this document.

  1. If you believe that the processing of your personal data has violated the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the country of your habitual residence, place of work, or place where the alleged violation occurred. The supervisory authority for the Czech Republic is the Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, 170 00 Prague 7, Czechia, ID No.: 708 37 627, https://uoou.gov.cz/.
